Cancellation and Refund Policy
Your wedding date is reserved exclusively for you once your booking is confirmed. As wedding illustration bookings involve preparation, planning and the reservation of a specific date, the following cancellation and refund policy applies.
Cancellation 90 Days or More Before the Wedding
If you cancel 90 days or more before your wedding date, you will receive a full refund of all payments made, excluding the non-refundable booking fee.
The booking fee is retained to cover the administration, planning and reservation of your wedding date.
Cancellation 60–89 Days Before the Wedding
If you cancel between 60 and 89 days before your wedding date, you will receive a 50% refund of the total amount paid.
The remaining 50% will be retained to cover preparation, administration and the loss of the opportunity to accept another booking for your date.
Cancellation 30–59 Days Before the Wedding
If you cancel between 30 and 59 days before your wedding date, you will receive a 25% refund of the total amount paid.
The remaining balance will be retained to cover work already undertaken and the increasing difficulty of re-booking your wedding date.
Cancellation Less Than 30 Days Before the Wedding
If you cancel less than 30 days before your wedding date, no refund will be provided.
At this stage, the wedding date has been held exclusively for you and significant preparation may already have taken place, making it unlikely that the date can be re-booked.
Change of Wedding Date
If you need to change your wedding date rather than cancel your booking, please contact me as soon as possible. I will always do my best to accommodate a new date, subject to availability.
Where the new date is available, your booking and payments can be transferred to the new date.
Cancellation by Cherie Smith – Fine Art Portraits
In the unlikely event that I am unable to provide the agreed service, I will offer to reschedule where possible. If an alternative date cannot be agreed, you will receive a full refund of payments made for services that have not been provided.
Exceptional Circumstances
If circumstances outside either party’s reasonable control significantly affect the wedding or the provision of the service, I will discuss the situation with you and, where possible, seek a reasonable solution such as transferring the booking to an alternative date.
Return and Refund Policy
Refunds
Where a refund is due under this policy, it will normally be processed within 14 days of the cancellation being confirmed, using the original payment method where possible.
By confirming your booking, you acknowledge and agree to the cancellation and refund terms outlined above.
All returns must be postmarked within fourteen (14) days of the purchase date. All returned items must be in new and unused condition, with all original tags and labels attached.
RETURN PROCESS
To return an item, please email customer service at cheriesmith.art@gmail.com to obtain a Return Merchandise Authorisation (RMA) number. After receiving a RMA number, place the item securely in its original packaging, and mail your return to the following address:

Please note, you will be responsible for all return shipping charges. We strongly recommend that you use a trackable method to mail your return.
REFUNDS
After receiving your return and inspecting the condition of your item, we will process your return. Please allow at least seven (7) days from the receipt of your item to process your return. Refunds may take 1-2 billing cycles to appear on your credit card statement, depending on your credit card company. We will notify you by email when your return has been processed.

This website is owned and operated by Cherie Smith Art. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors an opportunity to purchase original artwork in the form of an image painted with oil on canvas stretched onto a frame or a drawing, or watercolour image using charcoal on paper or watercolour medium. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
In order to use our website and/ or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/ or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Copyright & Intellectual Property
All artwork created by Cherie Smith – Fine Art Portraits remains the intellectual property of the artist unless otherwise agreed in writing.
You are granted personal use of your commissioned artwork. This means you may display, print, and share the artwork for non-commercial purposes.
You may not:
● Reproduce the artwork for commercial use
● Sell or license the artwork
● Alter or edit the artwork for resale or commercial gain
The artist reserves the right to use images of completed artwork for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing.
Working Conditions (Live Events)
For live wedding illustration bookings, the client agrees to provide:
● A suitable working space with reasonable lighting
● A stable surface or table
● Access to seating for the artist
● Reasonable access to refreshments and breaks
The artist will require short breaks during long events to maintain quality of work.
Breaks & Working Hours
For events exceeding 3–4 hours, short breaks may be taken at reasonable intervals. For full-day bookings, a longer break will be required.
Working hours will be agreed in advance. Any extension beyond agreed hours may incur additional charges.
Health & Safety
The client is responsible for ensuring that the working environment is safe and suitable for the artist.
The artist reserves the right to stop work if they feel unsafe, unwell, or if conditions are unsuitable (including overcrowding, poor lighting, or disruptive environments).
The artist is not responsible for any injury, loss, or damage caused by unsafe conditions at the venue.
Public Interaction & Conduct
During live events, the artist may interact with guests. However:
● Guests must not interfere with the artwork or materials
● Equipment must not be touched without permission
● The artist reserves the right to refuse interaction if behaviour is disruptive or inappropriate
The client is responsible for ensuring respectful conduct towards the artist at all times.
Travel & Expenses
Travel costs may be included or charged separately depending on location. Any additional expenses such as parking, accommodation, or extended travel will be agreed in advance.
Liability
The artist will not be held liable for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to illness, accidents, travel disruption, or venue restrictions.
Agreement
By confirming your booking, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
Purchase of item online
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services/ for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.
For any undamaged product, simply return it with its included accessories and packaging along with the original receipt within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased.
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Cherie Smith Art. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
You agree to indemnify and hold Cherie Smith Art harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, in no event shall Cherie Smith Art, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/ or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in London. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
